1. Acceptance of Terms

By downloading, installing, accessing, or using BeerGenie ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

BeerGenie is a mobile application that functions primarily as a drink counter and drinking habit tracker. The App's core functionality includes logging drinks, tracking consumption sessions, viewing drinking history in calendar format, monitoring statistics, tracking dry streaks, setting personalized daily limits, and receiving water reminders.

The App also offers optional educational BAC estimates that are hidden by default. These optional estimates can only be enabled by users who explicitly choose to activate them through settings after acknowledging appropriate disclaimers. These optional estimates are based on general formulas and calculations that may not reflect your actual BAC.

The App is provided for informational purposes only and should not be used as a substitute for professional medical, legal, or safety advice. The core drink counting and tracking features work independently of any optional features.

3. Age Requirement

You must be of legal drinking age in your country or region of residence to use this App. By using BeerGenie, you confirm that you meet this age requirement and are legally permitted to consume alcohol in your jurisdiction.

4. Optional BAC Estimates - User Responsibility

BeerGenie is primarily a drink counter and habit tracker. The App's core functionality does not include BAC estimates. BAC estimates are an optional feature that is hidden by default and can only be enabled by users who explicitly choose to activate them.

If you choose to enable optional BAC estimates, you do so at your own risk and responsibility. By enabling this optional feature, you acknowledge and agree that:

• You have read and understood all disclaimers presented when enabling the feature
• You understand that BAC estimates are approximations only and may not reflect your actual blood alcohol content
• You will NOT use these estimates to determine your fitness to drive or operate machinery
• You accept full responsibility for any decisions or actions taken based on these optional estimates
• BeerGenie, its developers, owners, and affiliates are not responsible for any consequences resulting from your use of optional BAC estimates

DO NOT use optional BAC estimates to determine your fitness to drive or operate machinery. Many factors affect BAC that are not accounted for by the App, including but not limited to:

• Individual metabolism rates
• Food consumption
• Medications and drug interactions
• Medical conditions
• Individual physiology and tolerance
• Time of consumption

BeerGenie does not provide medical, legal, or professional advice. Any optional BAC estimates, safety recommendations, and other information provided by the App are estimates and approximations based on general formulas.

5. Limitation of Liability

YOU USE THIS APP AT YOUR OWN RISK. BeerGenie, its developers, owners, and affiliates (collectively, "we" or "us") shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App
• Any errors or inaccuracies in optional BAC estimates or calculations (if enabled)
• Any decisions made based on information provided by the App, including but not limited to decisions made based on optional BAC estimates
• Any harm resulting from driving or operating machinery after consuming alcohol, whether or not you used optional BAC estimates
• Any violation of laws or regulations related to alcohol consumption
• Your decision to enable and use optional BAC estimates

SPECIFICALLY, if you choose to enable optional BAC estimates, you acknowledge that:

• We are not responsible for the accuracy of these optional estimates
• We are not responsible for any decisions you make based on these optional estimates
• We are not responsible for any harm, injury, legal consequences, or damages resulting from your use of optional BAC estimates
• You assume all risk and responsibility for enabling and using optional BAC estimates

NEVER DRINK AND DRIVE. Always err on the side of caution. When in doubt, don't drive. Arrange for a designated driver, use a rideshare service, or wait until you are completely sober.

6. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Accuracy or reliability of BAC calculations
• Non-infringement of third-party rights

We do not warrant that the App will be uninterrupted, secure, error-free, or free from viruses or other harmful components.

7. User Responsibilities

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Not use optional BAC estimates (if enabled) to determine if you are fit to drive or operate machinery
• Not rely on optional BAC estimates (if enabled) as the sole basis for making decisions about alcohol consumption or safety
• Accept full responsibility for your decision to enable and use optional BAC estimates
• Provide accurate information when using the App
• Comply with all applicable laws and regulations regarding alcohol consumption
• Not use the App if you are under the legal drinking age
• Accept full responsibility for any consequences of your use of the App, including but not limited to consequences resulting from your use of optional BAC estimates

8. Indemnification

You agree to indemnify, defend, and hold harmless BeerGenie, its developers, owners, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of or access to the App
• Your violation of these Terms
• Your violation of any law or regulation
• Any decisions or actions taken based on information provided by the App, including but not limited to decisions made based on optional BAC estimates
• Your decision to enable and use optional BAC estimates

9. Account and Data

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason we deem necessary.

You may delete your account and associated data at any time through the App settings. Upon deletion, your data will be removed from our systems in accordance with our Privacy Policy.

10. Third-Party Services

The App may integrate with third-party services (such as Firebase, Google AdMob, and Apple StoreKit). Your use of these services is subject to their respective terms and conditions and privacy policies.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

12. Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the App shall be resolved in the appropriate courts of the United States.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeerGenie regarding your use of the App and supersede all prior agreements and understandings.

Introduction

BeerGenie ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard your information when you use our mobile application.

Information You Provide

When you create an account, we collect:

• Email address
• First and last name
• Date of birth (to verify legal drinking age)
• Biological sex (used for optional BAC estimates and personalized tracking)

Information Collected Automatically

• Drinking session data: Drinks logged, timestamps, and optional estimated BAC levels (if enabled)
• App usage data: Features used and session duration
• Device information: Device type, operating system version

Advertising Data

If you use the ad-supported version of our app, we use Google AdMob to display advertisements. AdMob may collect device identifiers and usage data for ad personalization. You can opt out of personalized ads through your device settings.

How We Use Your Information

We use your information to:

• Provide optional educational BAC estimates (if enabled by user)
• Provide personalized hydration reminders and safety notifications
• Track your drinking history and provide statistics
• Display relevant advertisements (free version)
• Improve our app and user experience

Data Storage and Security

• Cloud & Local Storage: Your profile and session history sync to the cloud (Firebase/Firestore) and may be cached locally for offline access.
• Secure Storage: Passwords are handled by Firebase Authentication and secured per Google's standards; sensitive tokens are stored in iOS Keychain where applicable.
• Your Control: You can delete your account and associated data from within the app; uninstalling the app removes local caches.

Third-Party Services

Google AdMob (Advertising)

Used to display advertisements in the free version. Has its own privacy policy: Google Privacy Policy. You can opt out of personalized advertising in your device settings.

Apple StoreKit (In-App Purchases)

Used to process the "Remove Ads" purchase. Handled entirely by Apple according to their privacy policy.

Firebase (Authentication & Database)

Firebase Authentication manages sign-in and credentials. Firestore stores user profile and session history to sync across devices. See Google's privacy policy for Firebase services: Google Privacy Policy.

Your Rights

You have the right to:

• Access: View all data stored by the app
• Delete: Remove your account and all associated data (cloud and local caches)
• Opt-out: Disable personalized advertising
• Data Portability: Data is stored in Firebase and cached locally; you may request export via the contact email below

Children's Privacy

BeerGenie is intended for users of legal drinking age only. We do not knowingly collect information from anyone under the legal drinking age in their jurisdiction. If you are under the legal drinking age, please do not use this app.

Age Verification

By using BeerGenie, you confirm that you are of legal drinking age in your country or region of residence.

BAC Estimates

Blood alcohol content (BAC) estimates in BeerGenie are calculated using the Widmark formula, a widely recognized method for estimating blood alcohol content based on alcohol consumption, body weight, biological sex, and time elapsed.

These estimates should never be used to determine fitness to drive or operate machinery.

Standard Drink Reference

Standard drink definitions used in BeerGenie are based on guidelines from the National Institute on Alcohol Abuse and Alcoholism (NIAAA). One standard drink contains 0.6 fluid ounces (14 grams) of pure alcohol.

Drinking Limits & Recommendations

Daily and weekly drinking limits recommended in BeerGenie are based on guidelines from the Centers for Disease Control and Prevention (CDC) and the National Institute on Alcohol Abuse and Alcoholism (NIAAA). These recommendations are for moderate alcohol consumption and may not be appropriate for everyone.
